2.8 How to avoid conflict of interest during the tender process?

It is better to define first the Conflict of interest: this is when the impartial and objective exercise of the functions is compromised for reasons involving family, emotional life, political or national affinity, economic interest or any other shared interest with the beneficiary.

Any firm or expert participating in the preparation of a tender must be excluded from participating in tenders based on this preparatory work, unless they can prove to the Contracting Authority that the involvement in previous stages of the project does not constitute unfair competition.

The Chairperson must check that no member of the Evaluation Committee has a potential conflict of interest with any of the tenderers and the members are completing and signing the declaration of impartiality and confidentiality statement.
